Agreement for the Sale of Precious Metal Materials to Roberts Bullion Scrap Gold & Silver Buyers
This Agreement ("Agreement") governs the sale of precious metal materials ("Materials") by any individual or business entity (the "Customer") to *Roberts Bullion Scrap Gold & Silver Buyers* ("Roberts Bullion").
1. Definitions
Material - Refers to any precious or non-precious metals or related items submitted by the Customer for evaluation and purchase.
Customer - Refers to any individual, company, or entity submitting Materials to Roberts Bullion for evaluation and purchase.
2. Price Quotation
- All preliminary price quotations provided by Roberts Bullion before the receipt of Materials are indicative and subject to market fluctuations.
- Final pricing shall be determined based on the prevailing market rates at the precise date and time when the Materials are physically received by Roberts Bullion.
3. Shipping and Insurance Requirements
- The Customer is advised to send all parcels containing precious metals via Royal Mail 1pm Special Delivery, with appropriate insurance coverage selected based on the declared value of the Materials. Royal Mail offers insurance coverage levels of £750, £1,000, and £2,500.
- For Materials valued above £2,500, the Customer is strongly recommended to divide the shipment into multiple parcels to ensure adequate insurance coverage.
- In the event that a parcel is lost during transit, Roberts Bullion shall provide full support to the Customer in filing a claim with Royal Mail for the reimbursement of the declared value.
- The Customer is required to take clear photographs, record the weight, and obtain an approximate valuation of the Materials prior to dispatch, to facilitate any potential claims process.
4. Payment
- Payment for the Materials shall be made via bank transfer upon completion of testing and verification by Roberts Bullion.
- The Customer must provide the following details for payment: bank name, account name, account number, and sort code.
- A sales receipt will be issued to the customer. The customer’s UK postal address and email address are required for this.
- For individual transactions exceeding £5,000, or cumulative transactions totalling £5,000, the Customer must provide a copy of a valid government-issued identification document (passport or driver’s license) in compliance with the Sanctions and Anti-Money Laundering Act 2018.
- The Customer’s personal data will be securely stored in accordance with the Data Protection Act 2018.
5. Right to Refuse Service
At its sole discretion, Roberts Bullion reserves the right to refuse to engage in business with any Customer, at any time, without providing a reason.
6. Testing and Assay Procedures
- All Materials received by Roberts Bullion are subject to destructive testing, which may include filing, drilling, acid testing, or mechanical deformation to determine authenticity and composition.
- Materials will undergo X-Ray Fluorescence (XRF) analysis, and may also be submitted to an independent third-party assayer for verification.
- Assay results and findings shall be communicated to the Customer prior to final payment. The Customer must confirm acceptance of the assay results before the disbursement of any funds.
7. Limitation of Liability
- Roberts Bullion shall not be liable for any damages, losses, or claims arising from market fluctuations, except in cases of proven negligence or willful misconduct.
8. Governing Law and Jurisdiction
- This Agreement shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the courts of England and Wales.
9. Acceptance of Terms
By submitting Materials to Roberts Bullion, the Customer acknowledges and agrees to the terms and conditions outlined in this Agreement.
10. Binding Agreement
This Agreement constitutes a legally binding contract between the Customer and Roberts Bullion Scrap Gold & Silver Buyers. By signing this Agreement or submitting Materials for evaluation and purchase, the Customer confirms their acceptance of all terms and conditions contained herein, and both parties agree to be legally bound by its provisions.
11. Entire Agreement
This Agreement represents the entire understanding between the parties concerning the sale of Materials and supersedes all prior or contemporaneous agreements, discussions, or representations. Any amendments to this Agreement must be made in writing and signed by both parties.
